1. Acceptance of Terms

By registering for membership, booking lessons, purchasing products, attending classes, or using Skyward Fencing’s services or facilities, you agree to be bound by these Terms of Service (“Terms”).

If you do not agree, you may not participate.

If the participant is under 18, a parent or legal guardian must accept these Terms on their behalf.

2. Services Covered

These Terms apply to all services provided by Skyward Fencing, including:

Memberships

Private lessons

Group classes, camps, clinics, and tournaments

Equipment sales and rent-to-own programs

Park district and partner programs

Facility usage

Online accounts, booking, and billing

3. Memberships & Billing

Memberships are billed on a recurring basis (monthly or annually unless otherwise stated). By enrolling, you authorize Skyward Fencing to charge your payment method on file automatically.

If a payment fails:

Access to training may be suspended

Services may be restricted until the balance is resolved

Membership fees are non-refundable.

Skyward Fencing reserves the right to update pricing with reasonable notice.

4. Cancellation Policy

Memberships may be canceled at any time.

Cancellation stops future billing

No refunds or prorated credits are provided for any unused time

This applies regardless of reason, including absence, injury, scheduling conflicts, or withdrawal.

5. Lessons & Class Policies

Private lessons and classes may be offered on a scheduled or flexible basis.

Once a lesson time is agreed upon, it must be honored. Cancellations with less than 24 hours’ notice may result in forfeiture

Classes and lessons may be accessed using prepaid sessions or credits

All lesson credits and class packages:

Are considered used upon attendance

Expire six (6) months from the date of purchase

Are non-refundable and non-transferable

Extensions may be granted at Skyward Fencing’s discretion.

Skyward Fencing reserves the right to modify scheduling, availability, and policies with notice.

6. Athlete Conduct

All participants are expected to maintain a respectful and safe training environment.

Skyward Fencing may suspend or remove any participant for:

Unsafe behavior

Harassment or misconduct

Disruption of training

Failure to follow club policies

No refunds will be issued in these cases.

7. Equipment & Rentals

All rental or rent-to-own equipment remains the property of Skyward Fencing until paid in full.

Participants are responsible for:

Loss or theft

Damage beyond normal use

Charges for repair or replacement may be applied to the payment method on file.

8. Assumption of Risk & Release of Liability

Participation in fencing and athletic training involves inherent risks, including but not limited to physical injury, illness, equipment failure, and accidental contact.

By participating, you acknowledge and accept these risks and agree to participate voluntarily.

You further agree to release, waive, and hold harmless Skyward Fencing LLC, its owners, coaches, staff, and affiliates from any claims or liabilities arising from participation, except where prohibited by law.

This section is intended to be read in conjunction with any signed liability waiver.

9. Medical Authorization

In the event of injury or medical concern, Skyward Fencing may take reasonable steps to seek emergency medical care if a parent, guardian, or emergency contact cannot be reached.

You accept full responsibility for any resulting medical costs.

10. Minors

Parents and guardians are responsible for:

Their child’s behavior

Timely pickup and supervision outside of scheduled activities

Maintaining accurate emergency contact information

Skyward Fencing is not responsible for supervision outside of scheduled training times.

11. Photography, Video & Likeness

Skyward Fencing may capture and use photographs or video of participants for instructional, promotional, and marketing purposes.

By participating, you grant Skyward Fencing permission to use your likeness in any media without compensation.

As outlined in our Privacy Policy:

This use may include websites, social media, promotional materials, and advertising

Consent may be revoked for future use by submitting a written request to hello@skywardfencing.com

Revocation does not apply to materials already created or distributed

12. Intellectual Property

All branding, curriculum, training systems, and materials are the property of Skyward Fencing LLC.

They may not be copied, distributed, or used for commercial purposes without written permission.

13. Payment Processing

Payments are processed through secure third-party payment providers.

Skyward Fencing does not store full payment card information.

By submitting payment, you agree to the terms of the selected payment provider.

14. Limitation of Liability

To the fullest extent permitted by law, Skyward Fencing LLC shall not be liable for any indirect, incidental, or consequential damages arising from participation or use of services.

Total liability for any claim shall not exceed the amount paid to Skyward Fencing in the preceding three (3) months.

15. Governing Law

These Terms are governed by the laws of the State of Illinois.

Any disputes shall be resolved in Cook or Lake County, Illinois.

16. Changes to Terms

Skyward Fencing may update these Terms at any time. Continued participation constitutes acceptance of any updates.
